A stunning rebuke from the bench has thrown the Justice Department’s case against former FBI Director James Comey into turmoil. A magistrate judge openly questioned the department’s tactics, accusing prosecutors of rushing to indictment before fully investigating the facts.

The indictment, handed down by a grand jury in Virginia, centers on two charges: false statements and obstruction of a congressional proceeding. These stem from Comey’s 2020 Senate testimony regarding leaks to the media concerning the Hillary Clinton email investigation.

Specifically, Comey is accused of falsely claiming he never authorized anyone to anonymously share information with reporters. However, evidence suggests he permitted his friend and lawyer, Daniel Richman, to leak details to The New York Times – and even encouraged the disclosure.

The core of the dispute now revolves around withheld evidence. Comey’s legal team alleges the Justice Department is deliberately concealing crucial materials, a constitutional violation they insist demands immediate attention.

Judge William Fitzpatrick didn’t mince words, describing the department’s approach as “highly unusual” and criticizing the order of operations: “indict first, investigate second.” This pointed criticism signals deep concern about the fairness and thoroughness of the prosecution.

Fitzpatrick issued a direct order, compelling the Justice Department to deliver all grand jury materials to Comey’s attorneys by a strict deadline. This move underscores the judge’s determination to ensure a transparent and equitable legal process.

Adding another layer of complexity, Comey’s lawyers argue that some documents used to build the indictment may be protected by privilege. They haven’t been allowed to review evidence gathered during a prior investigation, dubbed “Arctic Haze,” to determine if privileged information was improperly used.

“Arctic Haze” was a previous Justice Department inquiry, initiated during the Trump administration, focused on the source of leaks related to the Clinton email probe. It sought to uncover how classified details ended up in a 2017 New York Times article scrutinizing Comey’s decisions.
