Third youth charged in fatal shooting of eight-year-old Toronto boy

A third youth has been charged with first-degree murder in the stray-bullet fatal shooting of JahVai Roy, 8, in August.   

Toronto Police responded on Aug. 16 at 12:27 p.m. after gunshots were reported in the Martha Eaton Way and Trethewey Dr. area of North York.  

Police said officers arrived at the scene and found an eight-year-old boy in his residence who had been shot by a stray bullet while sleeping alongside his mom. Life-saving measures were performed and the victim was taken to a hospital via an emergency run, where he was later pronounced dead.  

Investigators identified three suspects and previously announced the arrest of two of them.   

Police initially announced that a 16-year-old was charged with first-degree murder and other weapons offences. Meanwhile, police said a 17-year-old and an 18-year-old were also being sought.  

On Sept. 25, investigators executed a search warrant in London, Ont., and one of two outstanding suspects was charged with first-degree murder.   

Investigators obtained judicial authorization to identify the youths wanted in relation to this investigation. That authorization has since expired and the youths can no longer be publicly identified.

ARREST MADE IN OSHAWA

Cops said the third accused was found and arrested by Durham Regional Police Sunday in Oshawa in connection with a separate investigation.  

Toronto Police have charged the third suspect with first-degree murder, two counts of failure to comply with an undertaking and breach of probation.   

The accused can’t be named under the provisions of the Youth Criminal Justice Act.  

“His love language was loud,” Roy’s mother, Holly, told a crowd gathered outside the family’s North York apartment building earlier this year for a vigil following the slaying. “He wanted to touch me, rub his mommy’s back. It was the little things. And that was our routine, in bed, snuggling.”
